Terms and Conditions
1. Scope
These Terms and Conditions govern the contractual relationship between Bernhard Kunz, Bauherrenstrasse 42, 8049 Zurich (“AMC Tribute”) and the customer (“Customer” or “You”). They apply to all orders placed via the online shop at www.amc-tribute.com.
By completing an order, you acknowledge the Terms and Conditions in force at the time of purchase. Any oral or telephone agreements must be confirmed in writing (email sufficient) to be binding.
2. Offer and Conclusion of Contract
The products displayed on the website do not constitute a legally binding offer by AMC Tribute, but an invitation to place an order. By completing the order process, you submit a binding offer to purchase the products in your shopping cart. You are bound by this offer for one week. The contract becomes effective once you receive an order confirmation from AMC Tribute by email.
3. Products
All information on the website (product descriptions, images, illustrations, etc.) is for illustrative purposes only and non-binding. It does not constitute a guarantee of characteristics. All offers are valid “while stocks last.”
4. Prices and Payment
All prices are quoted in Swiss Francs (CHF) and include, where applicable, advance recycling fees and copyright levies.
Voluntary donations exceeding the purchase price are welcome and will be used for charitable purposes in accordance with the values of the artist AMC.
AMC Tribute charges a flat shipping fee of CHF 8 for orders up to CHF 50. Orders exceeding CHF 50 are delivered free of charge. Any applicable shipping costs are displayed separately during the ordering process.
The price valid at the time of the order applies. Accepted payment methods include credit cards, PayPal, TWINT, and other payment services offered on the website.
5. Delivery
Delivery is made within Switzerland unless otherwise agreed. AMC Tribute strives to keep delivery times as short as possible. Any stated delivery dates are for information purposes only and are not binding.
The obligation of AMC Tribute is fulfilled once the goods are handed over to the carrier. Upon transfer to the carrier, the risk of accidental deterioration or loss of the goods passes to the customer. AMC Tribute is not liable for any fault on the part of the carrier.
6. Returns and Withdrawal
Returns of purchased goods are excluded. In case of visible transport damage, you must report it to the carrier within 14 days and contact AMC Tribute promptly at contact@amc-tribute.com.
7. Retention of Title
Goods remain the property of AMC Tribute until full payment has been received. AMC Tribute is entitled to make an entry in the retention of title register if necessary.
8. Warranty and Liability
Customers must inspect the products immediately upon receipt for correctness, completeness, and defects. Any defects must be reported without delay. Failure to do so results in the loss of warranty rights.
AMC Tribute may, at its discretion, remedy defects free of charge, provide a replacement, rescind the contract, or reduce the purchase price. In the event of rescission or reduction, the purchase price (or a portion thereof) will be refunded. The customer must provide AMC Tribute with their IBAN for reimbursement. Cash refunds are excluded.
AMC Tribute accepts no liability for damage caused by slight negligence or for indirect or consequential damages. Liability is unlimited only for personal injury or damage caused intentionally or by gross negligence.
9. Applicable Law and Jurisdiction
This agreement is governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-law rules of private international law. Exclusive place of jurisdiction is Zurich 1, Switzerland.
